RIGHT OF WITHDRAWAL

This section sets out the rules for withdrawal from the contract by Consumers and Entrepreneurs acting as consumers.

A Client who is a Consumer or an Entrepreneur acting as a consumer has the right to withdraw from the contract within 14 days, subject to the provisions below. To exercise the right of withdrawal, the Client should inform the Seller of their decision by means of a clear statement, such as an email or letter sent to the address indicated in the Terms and Conditions. More information on the right of withdrawal is included in Annexes 1 and 2 to the Terms and Conditions.

The right of withdrawal does not apply to contracts:

1. for the provision of services where the Client is obliged to pay a price, if the Seller has fully performed the service with the Client’s express prior consent and the Client was informed before the service started that they would lose the right of withdrawal once the service is fully performed, and the Client acknowledged this;

2. for the supply of digital content not supplied on a tangible medium, where the Client is obliged to pay a price, if the Seller started the provision of the digital content with the Client’s express prior consent, the Client was informed before the provision started that they would lose the right of withdrawal once the digital content is delivered, the Client acknowledged this, and the Seller provided confirmation of receipt of the consent;

3. where the subject of the contract is a non-prefabricated good made according to the Client’s specification or personalised to satisfy their individual needs (custom-made goods);

4. where the subject of the contract is sealed audio or visual recordings or computer software, if the seal has been broken after delivery;

5. where the subject of the contract is the supply of newspapers, periodicals, or magazines, except for subscription contracts;

6. concluded at a public auction;

7. where the goods supplied are inseparably mixed with other items after delivery due to their nature.

The Client referred to above is responsible for any diminished value of the Product resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics, and functionality of the Product.

In case of withdrawal from a contract for the supply of digital content or digital services, the Client shall refrain from using or sharing the digital content or service with third parties.

Annex 1 to the Terms and Conditions

INFORMATION ON THE RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires after 14 days from the day the contract was concluded (in the case of service contracts) / from the day you or a third party other than the carrier and indicated by you took possession of the goods, or in the case of goods delivered in instalments, from the day you took possession of the last instalment. In the case of contracts for regular delivery of goods for a specified period, the withdrawal period expires from the day you or a third party indicated by you (other than the carrier) takes possession of the first instalment.

To exercise the right of withdrawal, you must inform us of your decision by means of a clear statement (e.g., a letter sent by post or email).

You may use the model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal from the Contract

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than 14 days from the day we are informed about your decision to withdraw.

We will refund using the same means of payment you used for the original transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the refund.

If you requested that the performance of services begin before the withdrawal period expired, you shall pay us an amount proportionate to what has been performed until you informed us of the withdrawal from the contract.
